The following Terms and Conditions (Terms) apply to all purchase orders in our online shop available at https://saketos.co.uk, operated by Saketos sp. z o.o. ul. Biedrzychowicka 2, 59-921 Sieniawka, Poland, NIP (tax identification number): PL6152069414, REGON (statistical identification number): 524076026. Our business activity is registered in the Central Register and Information on Economic Activity (CEIDG) maintained by the Ministry of Economic pursuant to the provisions of the Act on Freedom of Economic Activity.
These Terms and Conditions apply to all orders placed by Consumers and Businesses through our online shop.
A Consumer is, in accordance with the Consumer Rights Act 2015, any natural person acting for purposes which are outside their trade, business, or profession.
A Business is any natural person, legal entity, or organisational unit with legal capacity that conducts trade or professional activities on its own account.
Other or supplementary terms and general trading conditions applied by Businesses shall not apply - they shall only become part of the contract if we explicitly agree to them in writing.
The contract of sale is concluded with Saketos sp. z o.o.
The presentation of products in our online shop constitutes an offer to conclude a contract of sale. To conclude a contract, you must add the selected products to your shopping basket and submit an order. Your shopping basket and the data entered in the forms can be modified before submitting your order using the available functionality and messages displayed during the ordering process.
By clicking the button confirming and finalising your order on the order summary page, you are submitting a binding order for the products in your shopping basket. As soon as your order is received and registered in our online shop system, the contract of sale is concluded. After submitting your order, you will receive an email from us confirming the order and the conclusion of the contract.
The contract of sale may be concluded in English.
We preserve the content of the contract and send you an email with details of your order. You can also check information about your orders through your customer account. These Terms and Conditions are made available on our online shop website in a manner that enables you to obtain, reproduce, and save the content.
For orders valued up to £74.99, delivery costs must be added to the stated product prices. For orders valued from £75 or more, delivery costs are not charged (free shipping).
The ordered products are delivered via courier companies working with us. Detailed information about possible delivery methods, delivery times, and shipping costs is presented during the ordering process and in a special information section on our shop website.
The products offered in the shop are sold exclusively via mail delivery. Unfortunately, personal collection is not possible.
The following payment methods are available in our online shop:
• Payment on delivery when the package is received.
• Electronic payments (e-payments) via an online payment service.
• Traditional bank transfer to our shop's bank account. If you choose this payment method - after placing your order, we will send you an email with the transfer details. Order processing will commence once the full payment amount has been credited to our account.

Consumers have a statutory right of withdrawal from the contract in accordance with the Consumer Contracts Regulations 2013.
The right of withdrawal also applies to individuals concluding a contract directly related to their business activity, if the nature of the contract indicates that it does not have a professional character based on the subject matter of their business activity. Other businesses do not have the right of withdrawal.
Products ordered from the shop remain our property until full payment of the sale price has been made.
For Consumers: In the case of consumer distance purchases, our shop always bears the risk of accidental damage or loss of goods in transit. If the ordered products are delivered with obvious damage incurred during transport, we ask that you report this defect to the courier as soon as possible and contact us. Delays in reporting such a complaint or making contact do not affect your statutory rights (described below in the complaints section) or their satisfaction. However, prompt notification assists us in pursuing our claims against the carrier or transport insurer.
For Businesses (excluding individuals concluding a contract directly related to their business activity where the contract does not have a professional character - so-called "quasi-consumers"): The risk of accidental loss or deterioration of the product passes to you at the moment we hand it over to the courier, carrier, or other person or institution responsible for delivery. We are not liable for loss, shortage, or damage to the product from the moment it is handed over for transport until it is delivered to you, nor for delays in delivery caused by the carrier.
Consumers have statutory rights under the Consumer Rights Act 2015 in relation to goods that do not conform to the contract. These rights are separate from and in addition to any statutory protections you may have.
If you wish to make a complaint about non-conformity or defects in goods, you should contact us as soon as possible at [email protected] with details of the issue.
Complaints should include a description of the defect, the order number, and supporting evidence (photographs if appropriate). We will investigate your complaint and respond within a reasonable timeframe.
Saketos offers customers the opportunity to receive marketing communications, including newsletters, notifications, and personalised offers. Marketing communications may include:
a) Transactional messages - directly related to order fulfilment (order confirmation, delivery status, returns information);
b) Wishlist notifications - information about product availability, price changes, or promotions for products added to your wishlist;

d) Promotions and offers - information about discounts, promotional codes, sales, and new products in the shop;

None of the provisions of these Terms and Conditions are intended to exclude or limit your statutory consumer rights. If any provision of these Terms and Conditions conflicts with consumer rights arising from applicable law, the statutory rights will always apply instead of the questioned provision.
For businesses, all contracts concluded with us shall be governed by the law of Poland, excluding the United Nations Convention on Contracts for the International Sale of Goods.
For businesses, legal persons under public law, or separate public law entities, the exclusive court of competent jurisdiction for resolving all disputes arising from contractual relationships between us and you shall be the court of competent jurisdiction for our registered office. This does not apply to individuals concluding a contract directly related to their business activity where the contract does not have a professional character based on the subject matter of their business activity.

The ODR platform is a multilingual, interactive website for handling consumers and traders seeking out-of-court settlement of disputes arising from the conclusion of distance contracts for the sale of goods or the provision of services.
The use of out-of-court methods of pursuing claims and dispute resolution is voluntary and can only take place if both parties to the dispute (Consumer and seller) consent to it.
The online shop is not responsible for customer content, particularly content that is illegal and posted on the website or platform if activities are non-compliant with these Terms and Conditions or applicable law.
Each customer or user of the online shop has the opportunity to report illegal content. If you believe that content violates the rules set out in these Terms and Conditions, you can inform the administrator by sending an email to [email protected]
The report should include the location where the administrator can view the content and all relevant contact details and information about third parties associated with the content (where possible). Decisions on reports are made solely based on information from persons with appropriate knowledge of the matter. The online shop does not use automated methods for handling and making decisions on reports. You will be informed of the outcome of the proceedings, its content, and justification without undue delay.
If the report you submit contains illegal content or content contrary to these Terms and Conditions, the online shop has the right to:
a) Remove or restrict visibility of such content
b) Prevent access to such content
c) Downgrade in search results
d) Suspend or terminate the provision of services in whole or in part, or suspend or close the shop account or that of a third party
We will communicate the justification to the affected recipients of the service for why restrictions have been applied. We will notify you and any third parties (if we have their contact details) of our decision, providing clear justification. You may appeal within 14 days by providing justification. The shop administrator will review the appeal within a further 14 days and will notify you of the decision and justification.
